Case Filed Against 19 People For Corruption in Procurement of MDMS A case has been filed against 19 people and two companies on the charge of irregularities in the purchase of a Mobile Device Management System (MDMS).
The Abuse of Authority Investigation Commission on Thursday filed a case against individuals and companies including the former presidents and current employees of the Nepal Telecommunication Authority in the MDMS procurement case, alleging corruption by causing illegal benefits and damages.
Former Chairman of Telecom Authority Digambar Jha and Purushottam Prasad Khanal, former Senior Director Anandraj Khanal, Directors Meen Prasad Aryal, Dipesh Acharya, and Surendra Lal Hada, Deputy Directors Vinod Chandra Shrestha, Revati Ram Panth, Sandeep Adhikari, Surya Prasad Lamichhane, Achyuta Nand Mishra and Vijay Kumar Rai are in the case. Yadav and assistant directors Pratishka Poudel and Niranjan Koirala have been made defendants.
Similarly, in the said case, the Group Chairman of Nuemera (M) Sdn Bhd, Malaysia, Datuk Mohd Nur Amin, Datuk Mohd Shihab, who was working in the said company and was involved in the negotiation of MDMS procurement, Chief Operating Officer Anuj Singh, Product Specialist Jamil Ahmad and the company’s partner company Namaste Global Com. Private Limited Singapore director Kabindra Raj Malla has also been made a defendant.
91 crores and 98 lakhs 30 thousand 882 rupees have been claimed against them for the offenses under the Prevention of Corruption Act, 2059. Similarly, they will be demanded to recover the fine of 232.2 million, 59 thousand 314 rupees spent so far in the name of setting up the MDMS system. Due to the payment in foreign currency, if the exchange rate is changed by the date of the judgment, the penalty should be calculated and fined.
According to the authority, a case was filed against them after the complaint was received about irregularities in the procurement of mobile device management system consulting services purchased by the Telecommunication Authority.
For MDMS, detailed study including demand collection, preparation of technical details, determination of procurement, package determination, preparation of cost estimate, eligibility determination and approved on the same basis by Section 6 of Public Procurement Act, 2063 and Rule 7 of Public Procurement Regulations, 2064 It is mentioned in the charge sheet of the authority that there is a legal provision to prepare/approve the procurement master plan including the type, quantity, procurement method, and the matters determined by the public procurement monitoring office to be included in the procurement master plan.
