TikTok User Humiliates Victim By Posting Intimate Video Of Victim In Bid To Go Viral In a bid to go viral, social media users have seriously violated a young woman’s privacy by posting videos of her intimate activities. For the past few days, social media platforms like Facebook and TikTok have been posting photos/videos of the young woman showing her private parts, thereby defaming her.
Some users have posted pictures of the girl saying, “If you want a scandal, message me,” while others have shared content containing confidential information in the name of reminding the girl. Some have insulted her by trolling and making memes about those pictures.
Such topics are easily visible when searching for what keywords are trending on TikTok. Some users have been found to have exceeded the limits of personal privacy in the greed of going viral.
According to him, if someone is proven to have committed such an act, he can be fined up to one hundred thousand rupees or imprisoned for five years, or both.
He said that if the victim girl files a complaint, anyone who records, shares, or stores the video on a device will be subject to action.
Section 47 (1) of the Electronic Transactions Act, 2063 states, “Any person who publishes or displays on electronic media, including computers, the Internet, materials prohibited by the prevailing law from being published or displayed, or materials that are against public morality, decency, or that spread hatred or malice towards anyone or disrupt the harmonious relations between different castes, races, and communities, or who teases, harasses, insults women, or does or causes them to do any other such indecent act, shall be punished with a fine of up to one hundred thousand rupees or imprisonment for five years, or both.”
On the other hand, under Article 306 of the Criminal Code 2074, there is a legal provision that it is not permissible to insult or defame someone, while Article 307 states that insulting someone electronically can be punished with imprisonment for up to three years or a fine of 30,000 rupees, or both.
If it is proven that an insult has occurred, the same code also provides for compensation to the victim and recovery of the costs incurred in the case from the offender.
