The Traffic Police Filed A Writ In The Court Saying That It Is Illegal To Seize Licenses And Blue Books A writ has been filed in the Supreme Court saying that the police are illegally confiscating driver’s licenses and vehicle owner’s certificates (blue book). In the petition filed by the petitioner Vivek Chaudhary with the Ministry of Home Affairs as an opponent, it is claimed that the police exceeded the legal limit.
In the writ, it is mentioned that the license and blue book were seized by the police in violation of the Vehicle and Transport Management Act, 2049 and the Rules, 2054. Chowdhury claimed that although the law gives the right to impose fines, the police are not given any right to take license or blue book under control.
In the petition, it is claimed that Articles 16 and 17 of the Constitution have been violated. It is said that Article 16 guarantees the ‘right to live with dignity’ and Article 17 guarantees the ‘right to freedom’. The petitioner demanded a judicial review of the said action, demanding the rule of law.
The writ was submitted on 1 Kartik 2081 and registered on 7 Kartik. The Supreme Court has called Chaudhary to appear in Thursday’s hearing.
