Such a provision has been proposed in the draft of the Information Technology and Cyber Security Bill recently published by the Ministry of Communication and Information Technology under the provision that privacy should not be breached. It is written in subsection 1 of section 89 of the bill, “No one shall, except by the law, receive any personal details or information, information, correspondence by electronic means without permission, break its confidentiality or make it available to anyone without permission.”
In sub-section (2) of section 89, no one shall use any mechanical device to listen to any communication conversation or signal between any two or more persons by electronic means, except when a complaint is made by the persons concerned or an order has been made by an authorized officer per law, or to record the sound of such matter or It is said that it should not be recorded or made.
But this rule will not apply in case of speech or statement made in public. It is mentioned in the bill that any notice, information, or correspondence can be listened to, recorded, or recorded even in the case of prevailing law.
If found guilty of this offense, a fine of up to three lakh rupees or imprisonment for up to three years or both have been proposed.
